Release of Liability and Code of Conduct
In exchange for participation in the activity of using a sewing machine, hand sewing needles, scissors, pins, and other sewing and crafting tools organized by Pretty Sharp Pins Sewing School, LLC, DBA "Fabric to Fashion Sewing School", of Long Beach, California and/or use of the property, facilities, and services of Pretty Sharp Pins, LLC, I agree for myself and for the members of my family, to the following:
Agreement To Follow Directions and Code of Conduct. All participants must agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Pretty Sharp Pins Sewing School LLC, or the employees, representatives, or agents of Pretty Sharp Pins Sewing School LLC. Including the following:
Be respectful to all participants and staff.
Take direction from staff / instructors.
Refrain from using abusive or foul language.
Refrain from causing bodily harm to self or other participants.
Refrain from damaging equipment, supplies, and facilities.
Refrain from harassment of staff / instructors or participants.
2. Assumption of the Risks and Release. I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and my family members (child), and further release and discharge Pretty Sharp Pins Sewing School, LLC for injury, loss, or damage arising out of my or my family's use of or presence upon the facilities of Pretty Sharp Pins Sewing School, LLC whether caused by the fault of myself, my family, Pretty Sharp Pins Sewing School, LLC or other third parties.
Description of Activity: Participants will engage in various sewing activities, including the use of sewing machines, scissors, needles, and other sewing tools.
Potential Risks:
Cuts from scissors or needles
Pinpricks or puncture wounds
Burns from irons
Strain from repetitive hand movements
Accidental injuries from sewing machines
Acknowledgment: By participating in the sewing classes or camps at Fabric to Fashion Sewing School, I acknowledge that I understand the nature of the activities and the potential risks involved.
Indemnification. I agree to indemnify and defend Pretty Sharp Pins Sewing School, LLC against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's (child) use of or presence upon the facilities of Pretty Sharp Pins Sewing School, LLC.
Fees. I agree to pay for all damages to the facilities of Pretty Sharp Pins Sewing School, LLC caused by any negligent, reckless, or willful actions by me or my family (child).
Applicable Law. Any legal or equitable claim that may arise from participation in the above shall be resolved under California law.
No Duress. I agree and acknowledge that I am under no pressure or duress to sign this agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this agreement if I so desire. I further agree and acknowledge that Pretty Sharp Pins Sewing School, LLC has offered to refund any fees I have paid to use its facilities if I choose not to sign this agreement.
Arm's Length Agreement. This agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this agreement or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity. Accordingly, the Parties specifically reject the application of Cal. Civ. Code §1654 to this agreement, as well as any other statute or common law principles of similar effect.
Enforceability. The invalidity or unenforceability of any provision of this agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this agreement or of any other applications of such provision, as the case may be. Such invalid or unenforceable provision shall be deemed not to be a part of this agreement.
Dispute Resolution. The parties will attempt to resolve any dispute arising out of or relating to this agreement through friendly negotiations among the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure: Any controversies or disputes arising out of or relating to this agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction.
Medical Authorization
In the event of an injury to the above minor during the above-described activities, I give my permission to Pretty Sharp Pins Sewing School, LLC (DBA Fabric to Fashion Sewing School) or to the employees, representatives, or agents of Pretty Sharp Pins Sewing School, LLC to arrange for all necessary medical treatment for which I shall be financially responsible. This temporary authority will begin upon signing and will remain in effect until terminated in writing by the undersigned or when the above-described activities are completed. Pretty Sharp Pins Sewing School, LLC shall have the following powers:
a. The power to seek appropriate medical treatment or attention on behalf of my child as may be required by the circumstances, including without limitation, that of a licensed medical physician and/or a hospital;
b. The power to authorize medical treatment or medical procedures in an emergency situation; and
c. The power to make appropriate decisions regarding clothing, bodily nourishment and shelter.
Youth Class Policies
1. Attendance Policy
All students/guardians must agree to our policies before their first class.
Please arrive no earlier than 10 mins to class. Doors will be locked if you arrive earlier than 10 mins.
No trials, walk ins or single drop in classes for sewing are available at this time.
Late Arrivals to any class, camp, or workshop could potentially forfeit the class/camp.
2. Agreement To Follow Directions and Code of Conduct
All participants must agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Pretty Sharp Pins Sewing School LLC, or the employees, representatives, or agents of Pretty Sharp Pins Sewing School LLC. Including the following:

Student Conduct and Disciplinary Action
First Warning: If a student is not following the rules and regulations of the class, they will receive a verbal warning from the instructor.
Second Warning: If the behavior continues after the first warning, the student will receive a second verbal warning.
Continued Misbehavior: If the behavior persists after the second warning, the parent or guardian will be contacted and asked to pick up the student from class early.
This policy ensures a respectful and conducive learning environment for all students.
3. After Class Pick Up/ Safety
The safety of all of our students at Fabric to Fashion is very important to us. Please make sure a parent or guardian is present at the end of every class to pick up your student. Your child is unsupervised and we cannot be responsible for them after their class has ended. Transition periods between classes allow our teachers to get mandated breaks and we want to make sure every student is safe and taken care of.
6. Extreme Weather Days
Fabric to Fashion will decide if we will remain open during serious storms. An email will be sent to all families by 3 pm if we decide to close Monday-Friday. Weekend classes will be notified as soon as possible.
7. Photo Release
By agreeing to this document I hereby grant Pretty Sharp Pins Sewing School DBA "Fabric to Fashion Sewing School" permission to use the likeness of my child in a photograph in website, marketing, and social media. I understand and agree that any photograph using my likeness or the likeness of my minor child will become property of Pretty Sharp Pins Sewing School DBA "Fabric to Fashion Sewing School” and because my participation is voluntary, I will receive no financial compensation.
I hereby hold harmless and release and forever discharge Pretty Sharp Pins Sewing School DBA "Fabric to Fashion Sewing School from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
